A custody hearing for temporary guardianship of Michael Jackson's children scheduled for Monday has been rescheduled for July 20 at the request of Katherine Jackson and Debbie Rowe, according to court officials.
"All prior orders remain in full force and effect, with Katherine Jackson as temporary guardian of the children," according to a Los Angeles Superior Court statement released Friday afternoon.
Michael Jackson's kids – Prince Michael I, 12, Paris, 11, and Prince Michael II (Blanket), 7 – have been living with their grandmother, Katherine, and staying at her Encino, Calif., home since the death of the pop icon on June 25.
Rowe, who is the biological mother of Prince and Paris, has not filed a petition for temporary guardianship, says a courthouse spokesperson. Blanket's mother has never been identified.
Last week, Rowe's attorney Eric George, said, "The truth is that Debbie has not reached a final decision concerning the pending custody proceedings."
This came on the heels of Rowe telling her former attorney and close friend Iris Finsilver that she intended to pursue custody. "Frankly, she won't have to fight for them, " Finsilver told PEOPLE. "She is the children's biological mother. She loves her children."
But Jackson's mother, Katherine, was named the guardian of his three children in his will, which was revealed last week. A source close to the family says of the Jacksons: "They will fight."
Debbie Rowe to Seek Custody of Jackson Kids
Debbie Rowe, the mother of Prince, 12, and Paris, 11, spoke to her former attorney Iris Finsilver, who says, "She is going to be pursuing custody of the children."Deborah Jeanne Rowe was Michael Jackson's dermatologist nurse. They got married in 1996 and divorced later in 1999. Rowe declared that she wanted Jackson to have the children as a "gift", so she gave up her parental rights, but from 2005, a family court case is under way regarding visitation rights. - Later the court turnover that decision.
Michael Jackson has yet another son, Blanket, apparently with a surrogate mother, born in the spring of 2002.
After the children were briefly seen in "Living with Michael Jackson" documentary, there were questions whether they are indeed Jackson's biological children, as they had no obvious African features about them.
Jackson has revealed that Blanket's mother was black.
The kids, along with a third child, Prince Michael II (Blanket), 7, whose mother is unknown, are in the temporary court-ordered care of Jackson family matriarch Katherine Jackson, 79, whom the singer named as guardian in his 2002 will. (Diana Ross was also named, in the event that Katherine is unwilling or able to care for the kids.)
Rowe earlier made her position clear in an interview with a Los Angeles television station, saying, "I want my children."
"I am stepping up," she told a reporter for Los Angeles station NBC 4 in a 90-minute phone conversation. "I have to."
Rowe also said she'd be willing to take custody of Blanket to keep the three children together, and she may seek a restraining order to keep her former father-in-law, Joe Jackson, away from her children.
Later, Rowe's current attorney left open the possibility that she could change her position. Calling her remarks to the TV station a "single snapshot of a single conversation," lawyer Eric George said, "Debbie has not reached a final decision concerning the pending custody proceedings."
"Frankly, she won't have to fight for them," Finsilver tells PEOPLE. "She is the children's biological mother. She loves her children."
