Israel has reprimanded two senior army officers who were responsible for firing white phosphorus artillery shells at a UN compound during last year’s offensive in Gaza.

In the first admission of any wrongdoing the Israeli military found that Brigadier-General Eyal Eisenberg and Colonel Ilan Malka were guilty “of exceeding their authority in a manner that jeopardised the lives of others”.

The Israeli report was in response to a damning UN investigation into the Gaza war, which concluded that both Israel and Hamas, the Palestinian group, had committed war crimes and possible crimes against humanity and which called on both sides to investigate the conduct of their forces.

An Israeli defence official said that its internal investigation could lead to further disciplinary action against soldiers involved in the 22-day offensive. The two officers disciplined yesterday were served a mild reprimand and had a “note” placed in their personal files noting their involvement. One defence official described the punishment as a “slap on the wrist.”

The Times first revealed that Israeli artillery was firing white phosphorus rounds into the heavily populated Palestinian enclave.

The reports were at first denied by the Israel Defence Forces (IDF), which admitted later that the munitions had been used to provide smoke and tracer illumination during the incursion. International law prohibits the use of white phosphorus in heavily populated civilian areas, but allows it in open areas to be used as cover for troops. The incident in the IDF report occurred on January 15 when General Eisenberg and Colonel Malka were responsible for bombarding the UN compound. During the incident, near the Tel al-Hawa neighbourhood south of Gaza City, Israeli forces from the Givati unit were exchanging fire with Hamas fighters.

Hamas held a position with a commanding view of advancing Israeli troops, with the UN’s headquarters directly between the two forces. The artillery attack by 155mm cannon, which took place while more than 700 Palestinian civilians were taking refuge inside, set light to a warehouse storing millions of dollars’ worth of aid for more than a million Gazans and destroyed tonnes of food and supplies.

A high-ranking UN official told The Times that half a dozen unexploded IDF shells were found in the UN compound and their serial numbers were traced to US factories. “The burning down of the UN compound in Gaza is massively symbolic,” said Chris Gunness, a UN spokesman.

Human rights groups have accused Israel of violating the rules of warfare in Gaza.

Although white phosphorus is not mentioned in the officers’ reprimands, the Israeli report reveals elsewhere that the munitions were in use. The shells disperse hundreds of pieces of felt soaked in the incendiary chemical, which continues to burn for as long as it is exposed to oxygen.

The IDF report said: “The primary rationale for deploying smoke screening munitions containing white phosphorus was to produce a smokescreen to protect Israeli forces from the Hamas anti-tank crews operating adjacent to the UNRWA headquarters. Such a smokescreen has proven an effective response to the anti-tank threat, since it effectively blocks the enemy’s field of view . . . The smokescreen created during the fighting in Tel al-Hawa was effective in achieving its military objective.” It concluded: “In the absence of the smokescreen, the fight would have continued in this area, and the IDF would have had to use reactive fire to engage anti-tank units, with the likelihood of greater civilian harm.”

PM Isreal condemn UN allow PM iran to give speech. Ahmednijah denies Holocaust occur.


PM Palestine Abbas said Israeil Settlement in Gaza must stop.


Netanyahu used Nazi-era documents to condemn what he said were the "tyrants of Tehran". Prove holocaust exists where 6million Jews were murdered. Iran PM Ahmednijah denied it occur.

Lately , Obama administrator has setback , when both side refuse to continue peace talk. Isreal refuse to stop construction in Gaza , while Palestine continue wants to assert control in Gaza.Obama, softening the call for a full freeze, said Israel should "restrain" settlement activity and announced further, lower-level talks to be held next week. But analysts were pessimistic about the chances of serious negotiations restarting on a two-state deal.

"A clear majority of Palestinians -- 55 percent -- favor a Palestinian state in the West Bank and Gaza ... just 11 percent favored either of the other alternatives under discussion, a bi-national state of Palestinians and Israelis or a confederation with neighboring Jordan and Egypt."

The survey was conducted in June and July. This week, U.S. President Barack Obama intervened personally in a bid to relaunch stalled peace talks, bringing Abbas together with Israeli Prime minister Benjamin Netanyahu for talks in New York.

Netanyahu again resisted international calls to freeze Israeli settlement in the West Bank, which Abbas says it must do in order for talks to resume. Israel says the Palestinians are not in a position to make peace as long as Hamas rules Gaza.

Turkish Prime Minister Tayyip Erdogan said on Saturday his country would push the Security Council to discuss a report by U.N. investigators accusing Israel and Palestinian militants of war crimes in the Gaza war.

"We will definitely take the position to discuss this issue on the Security Council," Erdogan told reporters.

A U.N. fact-finding mission led by South African jurist Richard Goldstone issued a report last week that said both the Israeli army and Palestinian militants had committed war crimes, and possibly crimes against humanity, during the December-January war in the Gaza Strip.


Both Israel and Hamas denied committing any war crimes. Israeli Prime Minister Benjamin Netanyahu has described the report of the Goldstone commission, which Israel refused to cooperate with, as a travesty.

UN accuses Israel of committing war crimes in Gaza

UN accuses Israel of committing war crimes in Gaza

A fact-finding team from the United Nations has accused Israel of committing war crimes in Gaza. The investigation set up by the Human Rights Council concluded that Israeli forces had been systematically reckless in their use of white phosphorus during the Gaza war earlier this year.

The investigators said in their report: “The mission believes that serious consideration should be given to banning the use of white phosphorus in built-up areas.

They singled out three Israeli attacks using white phosphorus — which is deployed as a smokescreen — saying that they were disproportionate or excessive under international law.

They said that Israel failed to take “all feasible precautions” in using white phosphorus shells in the attack on the UN Relief and Works Agency compound in Gaza City on January 15 despite the presence of up to 700 civilians. It also criticised the use of white phosphorus in attacks on Al Quds and Al Wafa hospitals.

The mission urged the UN Security Council to give both sides six months to investigate and prosecute offenders before turning the matter over the prosecutor of the International Criminal Court, a recommendation unlikely to be followed by the council.

The mission was set up in April by the UN Human Rights Council, which has a record of criticising Israel. It was led by Richard Goldstone, a South African judge who headed a commission on political violence in his homeland. Israel refused to co-operate with the investigation and yesterday dismissed its findings as prejudged.

The report accused Israel of breaking international law by deliberately attacking civilians, using Palestinians as “human shields” and torturing detainees. It added that the continuing Israeli blockade of Gaza could constitute persecution — a crime against humanity.

They said that Israel failed to take “all feasible precautions” in using white phosphorus shells in the attack on the UN Relief and Works Agency compound in Gaza City on January 15 despite the presence of up to 700 civilians. It also criticised the use of white phosphorus in attacks on Al Quds and Al Wafa hospitals.

Israel response to this accusation

IDF spokesman denied the use of phosphorus and said that Israel was using only the weapons that were allowed under international law.

Rows of the pale blue M825A1 WP shells were photographed on January 4 on the Israeli side of the Israel-Gaza border. Another picture showed the same munitions stacked up behind an Israeli self-propelled howitzer.

Confronted with the latest evidence, an IDF spokeswoman insisted that the M825A1 shell was not a WP type. “This is what we call a quiet shell - it is empty, it has no explosives and no white phosphorus. There is nothing inside it,” she said.

“We shoot it to mark the target before we launch a real shell. We launch two or three of the quiet shells which are empty so that the real shells will be accurate. It's not for killing people,” she said.

Major-General Amir Eshel, the army's head of strategic planning, said that firing shells to provide a smoke screen was legal. “It is the most nonlethal kind of weapon we used. I don't see any issue with that,” he said.

Israel and Jewish groups slammed the council for pre-emptive conclusions and for not accounting for the intensification of rocket fire under the rule of Hamas.
